Estates and Probate When a person dies, the property he/she owned at death is often referred to as his/her estate. Since a will controls the disposition of the probate estate, its validity - or invalidity - can impact on who will ultimately inherit the estate. In almost all states, probate courts (or similar type courts) have the power to accept or deny the admission of a will to probate. In addition, probate courts are responsible for the proper administration and distribution of probate estates.
