In General - Statutes of Limitations
Generally, a will contest must be brought promptly. The period of time within which a will contest must be brought is governed by state law. These laws are commonly referred to as statutes of limitations and specify the last date by which a will contest must be brought. If the contest is not brought within this time period, the contest is likely to be dismissed by the court unless there exist facts that "tolled" (i.e. suspended) the running of the applicable statute of limitation.
Because the time limits within which a will contest may be brought are generally very limited, action must be taken promptly.
