Probate proceeding can be either "formal" or "informal." A "formal" proceeding is necessary to determine the validity of a will and may be commenced by any interested person. Any person objecting to the admission of the will must file with the court his/her objections to the will. In will contests, the proponents of the will have the burden of proving that the will was duly executed. Contestants of the will have the burden of proving lack of testamentary intent or capacity, undue influence, fraud, duress, mistake or revocation.
